FIATLUX IMAGING™, INC. Privacy Policy

FIATLUX IMAGING™, INC. ("FiatLux") recognizes that its customers, visitors, and users (collectively, "Users" or individually, a "User") value their privacy. This Privacy Policy details important information regarding the use and disclosure of User information collected by FiatLux from Users in connection with their use of the FiatLux website(s) and related FiatLux services such as the FiatLux Visualize Free software (collectively, the "FiatLux Service"). FiatLux provides this Privacy Policy to help you make an informed decision about whether to use or continue using the FiatLux Service.

This Privacy Policy is incorporated into and is subject to the FiatLux Terms of Use. Your use of the FiatLux Service and any personal information you provide to us remains subject to the terms of this Privacy Policy and our Terms of Use.

Information FiatLux collects and how we use it

In order to provide our full range of services, we may collect the following types of information:

Information you provide: When you sign up for the FiatLux Service, we may ask you for personally identifiable information (such as your name, email address, mailing address, phone number, institution, and password). We use your personal information to operate, maintain, and provide to you the features and functionality of the FiatLux Service.

We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major FiatLux site changes or for customer service purposes).

Cookies information: When you visit web pages or otherwise use the FiatLux Service, we may send one or more cookies (small text files containing a string of alphanumeric characters) to your computer that uniquely identifies your browser. We use cookies to improve the quality of our service by storing user preferences and tracking user trends. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features and services of the FiatLux Service may not function properly if your cookies are disabled.

Log File Information: When you use the FiatLux Service, our servers automatically record information that your browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, browser language, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser. The log files may also include details on your usage of the FiatLux Visualize Free software, including registration status, time spent in the application, and usage patterns of software features.

Clear GIFs information: When you visit web pages using the FiatLux Service, we may employ "clear GIFs" (a.k.a. Web Beacons) which are used to track the online usage patterns of our Users anonymously (i.e., in a non-personally identifiable manner). In addition, we may also use clear GIFs in HTML-based emails sent to our Users to track which emails are opened by recipients.

User communications: When you send email or other communication to FiatLux, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.

Affiliated sites: We may offer some of our services in connection with other web sites. Any personal information that you provide to those sites may be sent to FiatLux in order to deliver such service and/or the FiatLux Service. We process such information in accordance with this Privacy Policy. The affiliated sites may have different privacy practices and we encourage you to read their privacy policies.

Links: FiatLux may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our services,

When FiatLux discloses information

We provide personally identifiable information and non-personally identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We require that these parties agree to process such information in compliance with the Privacy Policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

We do not share your personally identifiable information (such as name or email address) with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.

We reserve the right to share non-personally identifiable information (such as anonymous User usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the websites that part of the FiatLux Service.

We reserve the right to release personally identifiable information and/or non-personally identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws or respond to a court order, subpoena, or search warrant.

FiatLux also reserves the right to disclose personally identifiable information and/or non-personally identifiable information that FiatLux believes, in good faith, is appropriate or necessary to enforce our Terms of Use, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the FiatLux Service, and to protect the rights, property, or personal safety of FiatLux, our Users or others.

Your choices for personal information

When you sign up for a particular service that requires registration, we ask you to provide personal information. If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.

If we propose to use personal information for any purposes other than those described in this Policy and/or in the specific service notices, we will offer you an effective way to opt out of the use of personal information for those other purposes. We will not collect or use sensitive information for purposes other than those described in this Privacy Policy and/or in the specific service notices, unless we have obtained your prior consent.

You can decline to submit personal information to any of our services, in which case FiatLux may not be able to provide those services to you.

To protect your privacy and security, we may at our option take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to change your page or personal information. You are responsible for maintaining the secrecy of your unique password and account information at all times.

Our commitment to data security

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. FiatLux uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to FiatLux and you do so at your own risk. Once we receive your transmission of information, FiatLux makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

We restrict access to personal information to FiatLux employees, contractors, and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

If FiatLux learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. FiatLux may post a notice on the FiatLux Service if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should notify us by email.

When we receive formal written complaints, it is FiatLux's policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between FiatLux and an individual.

Our commitment to children’s privacy

Protecting the privacy of young children is especially important. For that reason, FiatLux does not knowingly collect or maintain personally identifiable information or non-personally identifiable information on the FiatLux Service from persons under 13 years of age, and no part of the FiatLux Service is directed to persons under 13. If you are under 13 years of age, then please do not use or access the FiatLux Service at any time or in any manner. If FiatLux learns that personally identifiable information of persons under 13 years of age has been collected on the FiatLux Service without verified parental consent, then FiatLux will take the appropriate steps to delete this information.

Special note to international users

FiatLux is hosted in the United States and is intended for and directed to Users in the United States. If you are a User accessing the FiatLux Service from outside the United States it is likely that the laws and regulations in your jurisdiction governing personal data collection, use, and disclosure, differ from those of the United States.  Please be advised that through your continued use of the FiatLux Service, which is governed by U.S. law, this Privacy Policy, and our Terms of Use, you are transferring your personal information to the United States and you consent to that transfer.

Data integrity

FiatLux processes personal information only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices to ensure that we collect, store and process only the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

In the event of merger, sale, or bankruptcy

In the event that FiatLux is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.

This Privacy Policy may be revised periodically and this will be reflected by the effective date below. Please revisit this page to stay aware of any changes. Your continued use of the FiatLux Service constitutes your agreement to this Privacy Policy and any future revisions.

We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes). Each new version of this Privacy Policy will be identified by its effective date below.
